Terms of Service

This is a legal agreement between you (the "USER"), and Rome Center for Molecular Design ("RCMD") at Drug Chemistry and Technology Department of sapienza University of Rome , covering your use of the www.3d-qsar.com ("3D-QSAR.COM"). Be sure to read the following agreement before using 3D-QSAR.COM.
RCMD is willing to license the use of 3D-QSAR.COM upon the condition that you accept all of the terms contained in this License Agreement and any supplementary license terms included herewith ("Agreement"). By using 3D-QSAR.COM, you agree to be bound by the terms of this Agreement.
If you do not agree to the terms of this Agreement you are not authorized to use 3D-QSAR.COM.
AS THE USER YOU AGREE TO ACCEPT THE FOLLOWING TERMS AND CONDITIONS:

1. 3D-QSAR.COM Software License to the USER

1.1 RCMD grants to the USER a non-exclusive, non-transferable license to use 3D-QSAR.COM solely for non-commercial purposes. No express or implied license is granted to USER for any other purpose. The USER shall not copy, modify, decompile, disassemble, decrypt, extract, or otherwise reverse engineer 3D-QSAR.COM.
1.2 "DATA" comprises any information about the physico-chemical and biological properties of chemical structures, experimental conditions, chemical identifiers, names and structures themselves that are submitted by users to 3D-QSAR.COM. The USER is granted a Creative Commons CC-BY (version 4.0) license to DATA submitted and made available by other users under this Agreement.
1.3 "MODELS" are implemented mathematical functions of 3D-QSAR.COM that use DATA. MODELS generated through 3D-QSAR.COM become a part of 3D-QSAR.COM Software. The USER is granted a Creative Commons CC-BY-NC (version 4.0) license to use these MODELS.

2. USER License on DATA and MODELS

2.1 The USER grants to all other users of 3D-QSAR.COM a right to use all DATA submitted by USER to 3D-QSAR.COM according to the Creative Commons CC-BY (version 4.0) license. The USER warrants, that to the best of his knowledge the DATA submitted by him to 3D-QSAR.COM does not infringe any intellectual property rights of a third party.
2.2 The USER grants to all other users of 3D-QSAR.COM a Creative Commons CC-BY-NC (version 4.0) license to use MODELS generated by USER through 3D-QSAR.COM.
2.3 The USER grants to RCMD a world-wide, non-exclusive, transferable and sub-licensable right to use MODELS generated by USER for research, teaching and any other (including commercial) purposes.

3. Confidentiality of DATA and MODELS

3.1 RCMD will collect DATA and other information supplied by USER to 3D-QSAR.COM for computational purposes.
3.2 By submitting DATA to 3D-QSAR.COM and by generating MODELS through the use of 3D-QSAR.COM, the USER makes such DATA and MODELS available to all other users of 3D-QSAR.COM according to Section 2.
3.3 The USER agrees that, if he registers on the 3D-QSAR.COM website and therefore provides personal Information as defined in the Privacy Policy below, he can be cited with his full and login name in conjunction with all MODELS and DATA he stores and publishes on 3D-QSAR.COM.

4. Limited Warranty.

4.1 3D-QSAR.COM IS LICENSED "AS IS." RCMD disclaims all warranties concerning software, information, data, structures and models express or implied, including, but not limited to any implied warranties of merchantability, fitness for a particular purpose or non-infringement of any intellectual property rights.
4.2. The DATA provided on the 3D-QSAR.COM website may contain inaccuracies and typographical errors. RCMD does not warrant the accuracy or completeness of the DATA or the reliability of any advice, opinion, statement or other information displayed or distributed through 3D-QSAR.COM. The USER acknowledges that any reliance on any DATA, opinion, advice, statement, memorandum, materials or information shall be at his sole risk. RCMD reserves the right, to its sole discretion, to correct any errors or omissions or, in exceptional cases, to delete any DATA or MODELS in any portion of 3D-QSAR.COM, provided such DATA or MODELS were identified to be erroneous, false (e.g., calculated rather than experimental values) incomplete or spurious by RCMD or by other USERs who are authorized to do it ("MODERATORs"). In most cases RCMD/MODERATORs will try to contact the USER before deleting the DATA, as well as notifying the USER via email about the reason of such action. Before permanent removal deleted DATA will be placed in a "Trash" folder on 3D-QSAR.COM and can be restored from it by the USER after correction of errors. RCMD may make any other changes to 3D-QSAR.COM and the Software, Data, materials and products, programs or services described or provided on 3D-QSAR.COM at any time without notice.
4.3 RCMD does not warrant the on-line availability of 3D-QSAR.COM and the DATA stored therein. RCMD may terminate 3D-QSAR.COM at its sole discretion at any time without notice according to Section 6.2.

5. Limitation of Liability.

5.1 In no event will RCMD be liable for any lost revenue, profit or data or for special, indirect, consequential, incidental or punitive damages however caused and regardless of the theory of liability arising out of the use or inability to use 3D-QSAR.COM, the DATA or software therein, even if RCMD has been advised of the possibility of such damages. The foregoing limitations shall apply even if the above stated warranty fails of its essential purpose.
5.2 Section 4.1, 4.2 and 5.1 apply accordingly to the USER, which provides DATA to 3D-QSAR.COM, in regard to the DATA provided.

6. Termination.

6.1 This License is effective until being terminated. This License will terminate immediately without notice, if USER fails to comply with any provision of this License. Upon termination, the account of the USER can be blocked and/or be removed.
6.2 RCMD reserves the right, to its sole discretion to terminate 3D-QSAR.COM at any time at its discretion. With termination of 3D-QSAR.COM this License will terminate immediately without notice from RCMD.
6.3. The Provisions of Section 3, 4 and 5 will survive any termination of this License Agreement.

7. Governing Law.

This Agreement is made under, shall be governed by and construed in accordance with the laws of Italy, excluding its choice of law provisions.

8. Severability.

Should any provision of this Agreement be invalid or unenforceable or should the Agreement contain an omission, the remaining provisions shall be valid. However, if in RCMD’s opinion deletion of any provisions of this Agreement by operation of this paragraph unreasonably compromises the rights or liabilities of RCMD, RCMD reserves the right to terminate this Agreement. By clicking the acceptance button and submitting DATA and MODELS to 3D-QSAR.COM, I acknowledge that I have read and fully understood the foregoing Agreement and I agree to abide by its terms and conditions.

Right To Information

You have at all times the right to information regarding your stored Personal Information, the origin of the information and its acceptor as well as to the purpose of the storage of your Personal Information. Privacy and Data Protection Policy

This is the privacy notice of www.3d-qsar.com. In this document, "we", "our", or "us" refer to RCMD (Rome Center for Molecular Design).

Introduction

This is a notice to inform you of our policy about all information that we record about you. It sets out the conditions under which we may process any information that we collect from you, or that you provide to us. The bases on which we process information about you

1. Information we process because we have a contractual obligation with you

When you create an account on our website and agree to our terms and conditions, a contract is formed between you and us.In order to carry out our obligations under that contract we must process the information you give us. You may withdraw your consent at any time by instructing us at info@3d-qsar.com or by deleting your account in the website (The button is in the Edit Profile form in every application of our website). However, if you do so, you may not be able to use our website or our services further.

3. Information we process for the purposes of legitimate interests

We may process information on the basis there is a legitimate interest, either to you or to us, of doing so. Where we process your information on this basis, we do after having given careful consideration to:

- whether the same objective could be achieved through other means
- whether processing (or not processing) might cause you harm
- whether you would expect us to process your data, and whether you would, in the round, consider it reasonable to do so
For example, we may process your data on this basis for the purposes of:
- record-keeping for the proper and necessary administration of our website

If you wish us to remove personally identifiable information from our website, you may contact us at info@3d-qsar.com or by deleting your account in the website. This may limit the service we can provide to you.

16. Verification of your information

When we receive any request to access, edit or delete personal identifiable information we shall first take reasonable steps to verify your identity before granting you access or otherwise taking any action. This is important to safeguard your information.

17. Use of site by children

Since we store personal information, If you are under 18, you cannot sign up in our website.

18. Encryption of data sent between us

We use Secure Sockets Layer (SSL) certificates to verify our identity to your browser and to encrypt any data you give us. Whenever information is transferred between us, you can check that it is done so using SSL by looking for a closed padlock symbol or other trust mark in your browser’s URL bar or toolbar.
